• What are the main steps in a lawsuit?

Posted by Dexter Kerr on March 7, 2026 at 10:47 pm

A lawsuit usually follows a series of structured legal steps that help the court fairly resolve a dispute between parties. While the exact process may vary depending on the type of case, most civil lawsuits follow a similar path from the initial filing to the final decision.

This legal document explains the claims being made against the defendant, the facts supporting those claims, and the type of compensation or relief the plaintiff is seeking.

This step is called service of process, where the defendant receives copies of the legal documents and information about how to respond.

    3. Defendant’s Response
The defendant is given a certain amount of time to respond to the complaint. In the response, the defendant may admit or deny the allegations, present legal defenses, or sometimes file counterclaims against the plaintiff.

    4. Discovery Phase
During discovery, both sides gather and exchange evidence related to the case. This can include documents, emails, witness statements, depositions, and written questions. Discovery helps both parties understand the facts and build their arguments before trial.

    5. Pre-Trial Motions and Settlement Discussions
Before the case goes to trial, attorneys may file legal motions asking the court to rule on certain issues or dismiss parts of the case. Many disputes are also resolved during this stage through negotiations, mediation, or settlements. For example, claims filed under laws such as the camp Lejeune Justice Act may go through similar pre-trial processes before reaching a final resolution.
